When canceling a sporting activity, will the participant be reimbursed?
Many associations in the sports sector had organized paid activities which were to take place during this period of confinement. These activities must be canceled following government decisions. As payment has sometimes been made in advance, the question of reimbursement arises.
The Minister of the Economy N. Muylle issued a ministerial decree which allows, under certain conditions, to offer a voucher rather than operating the reimbursement for 3 months from 20/03/2020.
When a sporting activity cannot take place due to the coronavirus crisis, the organizer is entitled to issue to the participant who paid for this activity, instead of a reimbursement, a voucher corresponding to the value of the payroll amount.
This voucher can be issued when the following conditions are met:
1 ° the same activity is subsequently organized in the same place or close to it;
2 ° the activity is reorganized in the year following the delivery of the voucher;
3 ° the voucher represents the total value of the amount paid for the original access ticket;
4 ° no cost will be charged to the holder of the access ticket for the issue of the voucher;
5 ° the voucher clearly indicates that it was issued following the coronavirus crisis.
On the other hand, when the activity is not reorganized under these conditions, the participant who has his access ticket or the voucher is entitled to reimbursement of the price of the original access ticket.
In this case, the person organizing the activity has three months from 20-03-2020 to reimburse the holder of the access ticket.
This Ministerial Order also provides that when the participant in the activity proves that he is unable to attend the activity on the new date, he will be entitled to reimbursement.
